Family Advice
Family – A key remit of the Law Centre is to provide services to people suffering from domestic abuse and to provide services relating to children. The Law Centre has links with domestic abuse forums in Surrey and in particular works closely with Surrey Women’s Aid on referrals and joint case work. Our family solicitor is closely linked with appropriate local services. In addition to referrals from domestic abuse forums our referrals come via CABx throughout Surrey, Social Services and other local solicitors. A key advantage the Law Centre provides is its ability to provide a complete service. So for example a case of domestic abuse will often have associated with it issues of divorce, and issues around children. If the parties are not married there may still be property issues and issues around children including financial provision for children. The large majority of the centre's Family Cases being conducted through the local courts will concern applications under one or usually more than one of the following Acts:
Matrimonial Cause Act 1973 – Divorce, Judicial Separation and Ancillary Relief
- Family Law Act 1996 – Non Molestation Orders and Occupation Orders and Transfers of Tenancy
- Trusts of Land and Appointment of Trustees Act – seeking orders for sale and\or declarations of financial interest
- Children Act 1989 – typically Residence, Contact, Prohibited Steps, Specific Issue, Removal from Jurisdiction and Schedule 1 Financial Provision for Children.
The Law Centre has also acted for local grandparents and parents in proceedings concerning children in care or being taken into care.
